Terms of Service
Last updated: September 23, 2026
These Terms of Service ("Terms") are a legal agreement between you and 1001744253 Ontario Inc., operating as CrowdSurge ("CrowdSurge", "we", "us", or "our"), and govern your use of the CrowdSurge website and the event pages, RSVP flows, and hosting tools it provides (together, the "Service"). By viewing an event page, submitting an RSVP, or hosting an event through the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What CrowdSurge Is
CrowdSurge helps people turn a planned get-together — a dinner, a beach day, a movie night — into a real, locked-in event once enough people confirm they're coming. Events are hosted by members of the Peek app and shared with attendees who may or may not be Peek members themselves. CrowdSurge does not charge for events, sell tickets, or process payments of any kind between hosts and attendees.
2. Accounts and Identity
CrowdSurge has no login or account system of its own. If you host an event, you do so through the Peek app, which is where your identity and verification live. If you're invited to an event as a guest, your invitation link is itself your access credential — it is not tied to a password or account. You are responsible for keeping any invite or event-management link you receive confidential, the same way you would a password. Anyone with the link can act as you within that event.
3. Eligibility
The Service is intended for adults. You must be at least 18 years old to host or RSVP to an event. Hosts reach CrowdSurge through the Peek app, which independently requires hosts to be 18 or older; CrowdSurge does not separately verify the age of guests who RSVP through an invite link, so hosts and attendees share responsibility for using reasonable judgment about who they invite.
4. Hosting an Event
- You are responsible for the accuracy of the event details you provide, including the time, venue, and description.
- An event only becomes visible as "confirmed" once at least three attendees have confirmed they're coming — this exists to prevent a listed "group event" from quietly being a one-on-one meetup in disguise.
- You can cancel an event you're hosting at any time using your event's management link.
- Venue details shown on an event page may be drawn from Google's location data. CrowdSurge does not guarantee the accuracy of venue information, availability, or that the venue is aware of or has agreed to host your event — confirm directly with the venue if that matters to your plans.
- We may edit an event's title or description, or remove an event entirely, if it violates these Terms or is reported to us as unsafe, fraudulent, or abusive. We will not silently alter what an event is actually about.
5. Attending an Event
CrowdSurge does not run background checks on hosts, attendees, or venues, and does not supervise or attend events. You are solely responsible for your own safety and conduct at any event you attend, exactly as you would be at any other in-person gathering arranged online. Exercise ordinary caution, and use your own judgment about whether an event, host, or venue seems trustworthy before attending.
6. Comments and Conduct
Comments posted on an event page are meant for coordinating logistics with other attendees. You agree not to post content that is offensive, harassing, or illegal, and not to use comments to harass, threaten, or impersonate anyone. We may remove comments or an entire event that violates this.
7. Relationship to Peek
CrowdSurge is the system of record for events created through the Peek app's GroupUp feature. Peek remains responsible for the identity and verification of its own members; CrowdSurge is responsible for event listings, RSVPs, and the guest-invite flow described above.
8. Disclaimers and Limitation of Liability
The Service is provided "as is," without warranties of any kind. To the maximum extent permitted by law, CrowdSurge is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including anything that happens at an event you host or attend, or your interactions with any other host, attendee, or venue.
9. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts of Ontario for any dispute arising from these Terms or the Service.
10. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date at the top of this page.
